Terms of Service

1. Acceptance of terms

By downloading, installing, or using the ThinkGrid application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legal agreement between you and FlorisVrijdag ("we", "us", or "our"), the developer and publisher of ThinkGrid.

2. Description of the app

ThinkGrid is a mobile application available on iOS. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for any such changes.

3. Eligibility

You must be at least 4 years old to use ThinkGrid. By using the App, you represent and warrant that you meet this requirement. If you are under 13 years of age, your parent or legal guardian must agree to these Terms on your behalf.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device you own or control, for personal, non-commercial purposes, subject to these Terms and the Apple App Store Terms of Service.

You may not:

  • Copy, modify, or distribute the App or its content;
  • Reverse engineer, decompile, or disassemble the App;
  • Rent, lease, loan, sell, or sublicense the App;
  • Use the App for any unlawful purpose.

5. In-app purchases

ThinkGrid may offer in-app purchases. All purchases are processed through Apple's App Store and are subject to Apple's payment terms. All purchases are final and non-refundable, except as required by applicable law or Apple's refund policy. We reserve the right to change pricing at any time.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

7. Intellectual property

All content, design, graphics, software, and other materials in the App are owned by or licensed to FlorisVrijdag and are protected by applicable intellectual property laws. The ThinkGrid name and logo are trademarks of FlorisVrijdag. You may not use them without our prior written consent.

8. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, FlorisVrijdag shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €10, whichever is greater.

10. Third-party services

The App may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms.

11. Apple requirements

These Terms are between you and FlorisVrijdag only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of any significant changes by updating the "Last updated" date at the top of this page or through a notification in the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
